This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and user agreement for access and/ or transacting and/ or usage of https://www.hippostores.com/(“Website”) and sets out the terms and conditions governing it and the disclaimer (“Terms & Conditions”).

This Website is owned and operated by Hippostores Technology Private Limited, a company incorporated under the Companies Act, 2013 (as amended from time to time), having its Registered Office at 4H, 4^th floor, Hansalaya, 15, Barakhamba Road, New Delhi -110001, hereinafter referred to as "Company" which expression shall, unless it be repugnant to the context or meaning thereof, include its successors and assigns.

Use of this Website is regulated by the Terms & Conditions provided herein. User’s visit, dealings, transactions and/or otherwise using this Website shall be treated as you have read, understood and hereby unconditionally accept these Terms & Conditions. These Terms & Conditions shall be treated as legally binding and enforceable agreement between the Company and the User. If the User does not agree with any and/or all of these Terms & Conditions, then the User should stop dealing with and/or cease to initiate and do any transaction on this Website. By impliedly or expressly accepting these Terms of Use, User also accept and agree to be bound by the Company’s Privacy Policy, as amended from time to time.

The information, products and services including but not limited to shopping services, search services, offered on this Website or through other mediums, whether now known or hereafter developed, is solely for the Users information and subject to the Users acceptance of the terms, conditions and notices contained herein and should not be considered as a substitute for professional advice.

Users use of the Website and/ or services is subject to the additional disclaimers and caveats that may appear throughout the Website. The Company, its affiliate companies, associate companies, subsidiaries, consultants, contractors, advisors, accountants, agents, service providers and/ or suppliers assume no responsibility for any consequence relating directly and/or indirectly to any action and/or inaction that the User take based on the information, services, Products (as defined hereinafter) and other materials offered on this Website. While the Company strives to keep the information relating to the various Products offered on this Website accurate, complete and up-to-date, the Company, its subsidiaries, affiliates, associate companies, accountants, advisors, agents, consultants, contractors, service providers and suppliers cannot guarantee, and will not be responsible for any damage and/or loss related to, the accuracy, completeness or timelines of the information.

The Company may change, suspend and/or discontinue the Product(s) at any time, including the availability of any feature, database and content on the Website. The Company may also impose limits on certain features and services and/or restrict User’s access to parts and/or all of the services without notice and/or liability to the Users.

In this Agreement (as defined hereinafter), 'Company' and 'User' have been collectively referred to as "Parties" and individually as "Party".

I. Definitions

The words and phrases used in these terms are defined as under unless repugnant to the context or meaning thereof:

1. "Agreement" shall mean agreement between the Company and User with terms and conditions as provided herein and includes the Privacy Policy, Disclaimer and all the schedules, appendices and references mentioned herein with all such amendments as effected by the Company from time to time.
2. "Company" shall mean Hippostores Technology Private Limited.
3. "Force Majeure Event" shall have the meaning ascribed to it in Clause VIII.
4. "Product(s)" shall mean any good and/or service offered for sale on the Website for consideration.
5. "User" / "Users" shall mean any person/persons and/or legal entity(ies) who visits, uses, deals with and/or transact at Website in any way.
6. "Website" shall mean https://www.hippostores.com/, a website owned and operated by the Company for facilitating online transactions including the related mobile site and mobile application introduced from time to time.

II. Eligibility

Any person who is above eighteen (18) years of age, transacting in legally acceptable currency and competent to enter into valid contract as defined under the Indian Contract Act, 1872 shall be eligible to visit, use, deal and/or transact at the Website. If User is not competent to enter into valid contract then User is prohibited to visit, use, deal and/or transact at the Website.

User warrants that all information supplied by User in using the services and accessing the Website, including without limitation Users name, email address, street address, telephone number, mobile number, credit / debit card and/ or any other payment instrument number and other payment details is correct and accurate.

The Company will do utmost to ensure that availability of the Website will be uninterrupted and that transmissions will be error-free. However, due to the nature of the internet, this cannot be guaranteed. Also, User access to the Website may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services at any time without prior notice. The Company will attempt to limit the frequency and duration of any such suspension or restriction.

III.  Amendment of Terms

The Company is entitled, at its sole discretion or as may be required by law, to amend these Terms & Conditions anytime without any prior intimation to Users. User shall continue be responsible and shall be bound to this Agreement as amended by the Company from time to time. Continued use of this Website shall constitute Users acceptance of the modified Terms and conditions of the Agreement.

IV.  Website Content

The Website and its content shall only be used in accordance with the terms of the Agreement. All Products/materials displayed on the Website are protected by intellectual property rights owned by the Company (as applicable), contractors, partners, and/ or suppliers as the case may be.

If a User uses any information available on the Website for any research that results in an article and/ or other publication, the User shall take prior written permission and ensure that no documents or graphics, including logos, sourced from the Website and/ or Products are modified in any way.

Without the prior written permission of the Company, or its appropriate affiliates, User agrees not to display and/or use in any manner, the Marks. Nothing contained in this Website should be construed as granting, by implication, estoppels, or otherwise, any license or right in and/ or to the Marks without the express written permission of the Company or such third party. All other trademarks are the property of their respective owners.

User’s misuse of the Products, material and/or Marks on the Website and in its contents, except as provided in this Agreement, is strictly prohibited. User is advised that the Company will aggressively enforce its rights in the Website and/ or services and its contents to the fullest extent of the law, including by seeking appropriate remedies including criminal sanctions solely at Users risk as to costs and consequences.

V. Registration Data

The Website and its content shall only be used in accordance with the terms of the Agreement. All Products/materials displayed on the Website are protected by intellectual property rights owned by the Company (as applicable), contractors, partners, and/ or suppliers as the case may be.

User shall be entitled to use the Website for any online shopping transaction after getting him/her registered on the Website after furnishing all relevant information relating to User as sought on the Website. User shall be solely responsible for the confidentiality of its User Id and Password.

User shall be solely responsible for the accuracy and correctness of all such details/information given by User during registration. If the Company has reason to doubt the correctness of any details/information furnished by User or in case any information furnished by User is found incorrect, false or misleading then the Company shall be entitled to cancel or suspend the registration of User permanently or for such period as the Company deems fit.

In order to ensure that the Company is not violating any rights that the User may have in his/her Information, User hereby agrees to grant in favour of the Company a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the database rights which the User has in his/her Information, including but not limited to rights in any media now or in future with respect to Users Information solely to enable the Company to use the information supplied by the User to the Company. The Company will only use Users Information in accordance with the Agreement.

User agrees and understands that the Company shall not be responsible in any manner whatsoever for any loss and/or damage to User due to incorrect, incomplete and/or false information furnished by User. The Company will not be responsible for any business loss (including loss of profits, revenue, anticipated savings, data) or any other indirect or consequential loss to User.

The User shall further be liable to be prosecuted and/or punished under applicable laws for furnishing false, incorrect, and/or misleading information to the Company.

VI. Representations and Warranties

User represents and warrants that User is the owner and/or authorised to share the information User gives on the Website. User confirms that the information is correct, complete, accurate, not misleading, does not violate, rules and regulations.

1. User undertakes to indemnify and keep indemnified the Company and its shareholders, directors, employees, officers, affiliates, consultants, contractors, partners and/ or suppliers for all claims resulting from detail/information User posts and/or supplies to the Company. The Company shall be entitled to remove any such detail / information posted by User without any prior intimation to User.
2. User agrees and undertakes that she/ he shall be solely responsible for his/her Information and confirms that information submitted by User is:
   • correct, complete, relevant and accurate, not fraudulent
   • does not stalk or otherwise harass another user
   • does not and shall not infringe any third party’s intellectual property, trade secret and/or other proprietary rights and/or rights of publicity and/or privacy
   • shall not be defamatory, libellous, unlawfully threatening and/or unlawfully harassing
   • shall not be indecent, obscene and/or contain pornography and/or contain any thing which is prohibited under any prevailing laws, rules & regulations, order of any court, forum, statutory authority
   • shall not be seditious, offensive, abusive, liable to incite racial, ethnic and/or religious hatred, discriminatory, menacing, tortuous, scandalous, inflammatory, blasphemous, in breach of confidence, in breach of privacy and/or which may cause annoyance and/or inconvenience.
   • shall not constitute and/or encourage conduct that would be considered a criminal offence, give rise to civil liability, and/or otherwise be contrary to the law.
   • shall not be or include material that is technically harmful (including, without limitation, computer/ mobile viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data or any other code or files) or other computer programming routines that may damage, detrimentally destroy, limit, interrupt, interfere with, diminish value of, surreptitiously intercept or expropriate the functionality of any system, data or personal information.
   • shall not create liability for the Company or cause the Company to lose (in whole or in part) the services of the Company's ISPs or other suppliers.
   • is not in the nature of political campaigning, unsolicited or unauthorized advertising, promotional and/ or commercial solicitation, chain letters, pyramid schemes, mass mailings and/or any form of spam or solicitation.
   • is not illegal in any other way.
   • Further, the User agrees and understands that the Company reserves the right to remove and/or edit such detail / information.
3. User undertakes and confirms that User shall not use the Company’s website, services and/or materials therein for any purpose that is unlawful and/or prohibited by the terms of the Agreement and/or under any applicable laws, rulings, notifications, orders of any court or statutory authority. User shall not use the Website, services and/or materials therein in any manner which could damage, disable, overburden and/or impair the Website and/or any services therein and/or the network(s) connected to the Website and interfere with other Users use and enjoyment of the Website and/or services therein.
4. User shall not attempt to gain unauthorized access to any service on the Website, other Users Account(s), Computer systems and/or networks connected to the Website through hacking, phishing, password mining and/or any other means (whether now known or hereafter developed or invented). User shall not or shall not attempt to obtain any materials or information through any means not intentionally made available to User through the Website. User agrees and understands that she/ he is responsible for all of his/ her activity in connection with the services and accessing the Website. Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of Users right to access the Website.
5. User may not post or transmit, or cause to be posted or transmitted, any communication or solicitation designed or intended to obtain password, account, or private information from any other User. As a condition of use of this Website, User warrants to the Company that User will not use this Website for any purpose that is unlawful or prohibited by these Terms & Conditions, notices and/ or by the applicable law. Also, User must not harass, intimidate or impersonate other Users or use any information obtained from the service in order to do so.
6. Certain elements of the Website will contain material submitted by other Users. The Company disclaims its responsibility for the content, accuracy, conformity to applicable laws of such material. Part of the Website contains advertising/other material submitted to the Company by third parties. Responsibility for ensuring that material submitted for inclusion on the Website complies with applicable laws is exclusively on the advertisers and the Company will not be responsible for any claim, error, omission and/or inaccuracy in advertising material. The Company reserves the right to omit, suspend and/or change the position of any advertising material submitted for insertion. Acceptance of advertisements on the Website will be subject to the Company’s terms and conditions which are available on request.

VII. Communications

When User visit the Website, User is communicating with us electronically. User will be required to provide a valid phone number while placing an order. The Company may communicate with the User by e-mail, SMS, phone call or by posting notices on the website or by any other mode of communication. For contractual purposes, User gives consent to receive communications (including transactional, promotional and/or commercial messages), from the Company with respect to User’s use of the website.

VIII. Events beyond the Company’s reasonable control

The Company will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control.

IX. Warranty Disclaimer

User releases the Company from all liability for User having acquired or not acquired Products, content through the Website and/ or services. The Website and/ or services may contain, or direct User to sites and/ or services containing, information that some people may find offensive and/or inappropriate. The Company makes no representations concerning any content contained in or accessed through these websites and/ or services, and the Company will not be responsible or liable for the accuracy, copyright compliance, legality or decency, or durability of the products, material contained in, or accessed or purchased through these websites and/ or services.

The services, Products, materials, information, content, Website and/ or any software are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose or non-infringement except as provided in the warranty terms of the said Products given by respective manufacturer of the said Products.

Although the Company has taken adequate safeguard, the Company makes no guaranty of confidentiality and/or privacy of any communication or information transmitted on the Website and/ or for the services and/or any web-site linked to the Website. Users uses this Website and/ or services at his/ her own risk in accordance with our privacy policy.

Changes are periodically made and added to Website and to the information herein. The Company, its subsidiaries, affiliates, associate companies, consultants, partners and/or its respective suppliers may make improvements and/or changes to this Website at any time.

The Website does not warrant, represent and/or endorse the correctness, authenticity, accuracy, completeness, reliability and/or validity of any opinion and/or other information displayed, uploaded, distributed, posted, emailed, transmitted and/ or otherwise contributed through the Website and/ or services by anybody other than the Company.

X. Governing law and Jurisdiction

This Agreement will be governed by and construed in accordance with the laws of India. User agrees to submit to the exclusive jurisdiction of the courts at Delhi.

XI. Waiver

If User breaches this Agreement and the Company takes no action, the Company will still be entitled to use its rights and remedies in any other situation where User breach this Agreement.

• Price of the products is ex-warehouse /ex-store. Freight charges will be extra.
• Seller is not responsible for unloading of stock at customer location, except for selected product categories, which will be communicated to the customer at the time of buying the product.
• If customer wishes to avail the service of unloading, then additional charges will be applicable.
• The products shall be delivered in accordance with the terms stipulated in the order booking form.
• Taxes shall be applicable as per prevailing laws of India.
• All products are sold on cash basis. Seller may at its discretion provide credit to the customer subject to the prevailing credit terms.
• Any return of the products sold shall be subject to our Return Policy.
• The customer should follow the manufacturer’s technical & safety instructions/user manual before use of the product.
• Seller shall not be liable for any claim or liabilities arising from or due to breach of any condition of warranty or non-adherence of the manufacturer’s technical & safety instructions/user manual by a customer.
• Title and risk of loss to the products shall be transferred to the customer upon fulfilment of (i) payment of the purchase price to Seller; and (ii) the transport vehicle leaves Seller’s store/warehouse, as applicable for delivery.
• Seller shall not be responsible to the customer for any failure to perform its obligations which are beyond its reasonable control.

This Price Match Guarantee Plan (hereinafter referred to as "Plan/ Offer") is sponsored, organized and administered by Hippostores Technology Private Limited (hereinafter referred to as "Company") wherein we match the price of product(s) with   prices of the Competitor on e-commerce platforms or an invoice of the Competitor for the same product.

By availing the Plan, the customer(s) fully and unconditionally agree(s) to accept and abide by the terms and conditions of the Plan hereinafter specified.

1. Eligibility Criteria:

a. The Offer is applicable on IHB purchase made by Individual Home Buyer /End User at Hippo Stores at West Delhi, Noida and Chandigarh (Zirakpur). This Offer shall not be applicable on SIS Brands - Hybon Elevators, Jindal Kitchens, Kalco, Evok & Deco Window; Tiles & Flooring – Natural Granite; Structural Material; and Electrical & Lighting- Industrial Cables.
b. Price match will be done for exact same product (having same model name/ number/ id/ SKU etc.).

6. On assessment if the price match received is found genuine then the difference amount will be credited to the Hippo Stores wallet or the customer will receive amazon vouchers of the same amount on email within 10 business days.

LOYALTY REWARD PROGRAM – TERMS AND CONDITIONS

The Loyalty Reward Program (hereinafter referred to as ‘Loyalty Program’) is sponsored, organized and administered by Hippostores Technology Private Limited (hereinafter referred to as ‘Company’) which awards benefits and rewards to our customer(s) as part of the membership proposition.

By participating in the Loyalty Program, customer fully and unconditionally agree(s) to accept and abide by the terms and conditions of the Program hereinafter specified.

Eligibility Criteria:

1. The Loyalty Reward Program is applicable on IHB orders for a minimum value of INR 50,000/- (excl of GST and other charges, if any) or above made by Individual Home Buyer /End User for any product (except SMT and SIS) offered at Hippo Homes at Noida, Greater Noida, Greater Noida West, Gurgaon, Zirakhpur (Chandigarh) and www.hippohomes.com. It is valid on purchase of more than 1 (one) category.
2. A customer become a member of the Loyalty Program by filling up the registration form by providing basic details including but not limited to phone number, name, date of birth and address. Your mobile phone number and customer ID will serve as unique identification for the Loyalty Program membership.
3. Each point earned by you as a member will be equal to one rupee. All eligible members (single invoice for INR 50,000/- or above for more than one category) will start as Blue Card Members by default. You will be upgraded to a slab as soon as you satisfy the criteria of minimum purchase value as per below details.

LOYALTY PROGRAM TIER STRUCTURE

Blue Card Member:

• Earn 2 points per INR 100 spent at Hippo Homes at Noida, Greater Noida, Greater Noida West, Gurgaon, Zirakhpur (Chandigarh) and www.hippohomes.com.
• To be eligible for the Blue Card, you’d need to make a cumulative purchase of INR 50,000/- (excl of GST and other charges, if any), or above in single invoice at Hippo Homes.
• Upgrade to the Silver Card can be done by making a cumulative purchase of INR 2,00,001/- (excl of GST and other charges, if any), from the date of enrolment.

Silver Card Member:

Gold Card:

Solitaire Card:

• To be eligible for the Solitaire Card, you’d need to make a cumulative purchase of INR 10,00,001/- (excl of GST and other charges, if any),  or above at Hippo Homes
• You will get a dedicated relationship manager along with Free delivery upon becoming a Solitaire Card Member.

1. The tenure of the Loyalty Program (to earn and redeem loyalty points) is December 05, 2024 to December 31, 2025.
2. Each Member is entitled only for one Card. In the event any applicant/Member has been issued more than one Card, it shall be responsibility of such applicant/Member to immediately inform Company of the same and submit with Company all the Card(s) issued subsequent to first Card for cancellation of such Card(s).
3. The Card is non-transferable and the benefits under the same shall accrue only to the Member to whom Card was issued (“Cardholder”). All points accumulated in card shall have validity upto December 31, 2025.
4. Member(s) will not be entitled to earn reward points on past purchases (prior to becoming member) or on purchases that are not made on their valid Card membership. The customer needs to scan the card at the time of billing or invoicing, in order to add points in their account.
5. The reward points will be credited within 24 hours from the date of invoicing. Customer can redeem points after 21 days from the date of credit of points and on or before December 31, 2025.
6. Your loyalty points earning is valid only on payments made by cash / credit card / debit card, select wallets and any other valid payment method that Company may notify from time to time.
7. Points accrued under the Loyalty Reward Program are for customer’s benefit and will not be transferred to anyone.
8. Redeemed/Lapsed Loyalty points shall not get credited back to member’s account under any circumstances.
9. The information that the customer will provide to the Company while filling up the application and redeeming points is processed and stored in the Company's information system. To help you get the maximum benefit out of the Loyalty Reward Program we will send you regular updates and relevant tips regarding your membership.
10. When you register for the Loyalty Reward Program you give us the right to communicate with you through email, SMS, phone calls, direct mail and other means of communication
11. Membership to the Loyalty Reward Program is free. Company reserves the absolute right to withdraw, cancel or suspend your membership (at its sole discretion) for any reason whatsoever.
12. If your right to use the Reward Points is suspended or terminated for any reason, your participation in the Program will be terminated. Company will not compensate you for unredeemed Reward Points in the event your Program participation is suspended or terminated.
13. Company reserves its rights to alter the benefits scheme at and for any particular period of time.
14. Company will not be responsible for any loss of Loyalty Points due to loss, misuse, surrender or transfer of mobile number by any Member.
15. Loyalty Points cannot be encashed. Loyalty Points are redeemable either against purchase of  products or services from the Reward Catalogue (rewards across the range starting from 500 points to 50,000 points) or purchase of selected goods from Hippo Homes in accordance with the prevailing redemption policy / schemes at the time of such redemption.
16. In case of any refund as per policy, Company shall reverse the Loyalty Points credited, if any, in respect of the value of such refund.
17. No Loyalty Points shall be credited to the extent purchase of goods or services was by way of redemption of Loyalty Points.
18. It is the responsibility of Member to check the Points balance from time to time by appropriate means. Company shall not provide any account statement to Member.
19. Loyalty Points are credited against the Member’s mobile number and as such cannot be pooled with, combined or transferred to any other mobile number
20. Company may, at its sole discretion reject the enrolment in the Membership Program for any reasons whatsoever as it deems appropriate.
21. Company’s computation of Loyalty Points shall be final and binding. Member shall not raise any dispute or question in respect of the same.
22. Member shall, at all times, be responsible to inform Company about changes in his/her personal details in order to enable Company to update its records. In the event such changes are not informed by Cardholder to Company, Cardholder shall not hold Company responsible or liable for any losses suffered by such Cardholder due to the same.
23. In respect of lost stolen or damaged Card, Cardholder agrees that a Card will only be re-issued when such Cardholder places a written request for re-issuance of a Card. Such request shall be accompanied by a duly filled fresh application form along with a re-issuance fee of INR 50/-. The details mentioned on duly filled fresh application shall be the same details which such Cardholder submitted at the time of issuance of original Card or as updated by such Cardholder from time to time in accordance with these terms and conditions.
24. In case, Cardholder does not fill the complete application form or details mentioned on the duly filled fresh application form does not match with the details in Company’s records, Company reserves the right to deny re-issuance of a Card. Member shall not raise any dispute or question in respect of the same. Company reserves the right to charge the Cardholder for re-issuance of the Card.

26. Customers shall comply with these terms and conditions and waives any right to claim any ambiguity in these terms and conditions and release, indemnify and hold harmless Company, and their respective affiliates, advertising and promotion agencies, and its respective agents, auditors, representatives, officers, directors and employees from and against any injuries, losses, damages, claims, actions, or any liability of any kind resulting from or arising from this Loyalty Program.
27. This Loyalty Program is subject to force majeure circumstances including without limitation to floods, natural disasters, war, act of terror, political unrests, technical snags, pandemic, epidemic, lockdown, act of God, act of Government or any circumstance beyond the reasonable control of the Company.
28. The Laws of India shall govern the Loyalty Program terms & conditions. Any dispute arising out of this Program shall be subject to the exclusive jurisdiction of the competent courts in Delhi.
